Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Monkeygun platform and services ("Service") operated by Barnett Labs ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.

1. The Service

Monkeygun is an AI-powered video creation platform. You provide text prompts and creative direction; our system generates scripts, voiceovers, images, video clips, and rendered video output. The Service includes the web application at monkeygun.com, the REST API at api.monkeygun.com, and any associated tools or integrations.

2. Accounts

You must provide a valid email address to create an account.
You are responsible for all activity under your account.
You must be at least 16 years old to use the Service.
One account per person. Shared or automated account creation is not permitted without prior approval.

3. Credits and Payments

The Service uses a credit system. 1 credit = $0.01 USD.
New accounts receive 500 free credits.
Additional credits can be purchased via one-time top-ups or monthly subscription plans.
All payments are processed by Stripe. You agree to Stripe's terms of service when making a payment.
Credits are non-refundable except where required by law.
Unused credits on free accounts do not expire. Subscription credits reset monthly.
We reserve the right to adjust credit pricing with 30 days' notice to existing users.

4. Subscriptions

Subscription plans (Pro, Agency) are billed monthly via Stripe.
You may cancel at any time. Cancellation takes effect at the end of the current billing period.
Upon cancellation your plan reverts to Free and monthly credit allotments stop.
We may change subscription pricing with 30 days' notice. Existing subscribers keep their rate until the next renewal after the notice period.

5. Your Content

You own your content. Prompts, scripts, images, and rendered videos you create through the Service are yours.
You grant us a limited license to store, process, and display your content as necessary to provide the Service.
You are responsible for ensuring your prompts and content do not violate applicable laws or third-party rights.
We may remove content that violates these Terms or applicable law.

5a. Rights in footage, music and voices

Monkeygun edits what you bring. When you upload, link or ask us to fetch footage, images or audio — including news clips, sports footage or other third-party material — you confirm you have the right to use it for the video you are making, or you accept responsibility for that use. Monkeygun flags rights questions it notices; it does not clear rights for you, and whether you distribute or monetize a video is your decision and your responsibility.

Music from our licensed library is covered for videos made and published through Monkeygun under our plan; tracks you upload must be yours to use. Stock media (Pexels, Giphy) carries its own licenses, which we surface with the file.

Voice cloning requires that the voice is yours or that you have the speaker's explicit permission; you confirm this each time you clone, and you may not clone public figures. Presenters generated from a photo require the same permission. We remove cloned voices and generated likenesses on a verified complaint.

6. AI-Generated Content

Your inputs stay yours. Footage, photos, audio, documents, and text you upload or connect ("Inputs") remain your property. You confirm you have the rights to use them, including the consent of any real person whose likeness or voice appears.
Outputs are yours to use. Videos, images, clips, voiceovers, and presenters generated for you ("Generated Content") may be used by you for any lawful purpose, including commercial use, subject to the terms of the underlying model providers.
License to Monkeygun. By generating content you grant Monkeygun a worldwide, non-exclusive, royalty-free, perpetual license to store, reproduce, adapt, combine, and display Generated Content to operate and improve the Service, to showcase and market Monkeygun (for example on our website, in demos, and on social media), and to train and evaluate the systems that make it. This license does not extend to your Inputs except as embedded in Generated Content, and never to a real person's likeness or voice or to Inputs you mark private, which we will not reuse without separate written consent. Email legal@monkeygun.com to stop future showcasing of a specific piece; we honor such requests within 14 days.
Your library. Everything generated for you is saved to your account library so you can reuse and edit it. We may retain copies as needed to operate the Service and to exercise the license above.
Generated Content may not be unique; similar outputs may be produced for other users. Review it before publishing — we do not guarantee accuracy or fitness for a purpose, and you are responsible for platform rules on disclosing AI content.

7. Acceptable Use

You agree not to use the Service to:

Generate illegal content, including but not limited to child exploitation material, content that incites violence, or content that violates export controls
Create deepfakes or impersonation content of real people without their consent
Generate spam, phishing, or deceptive content
Attempt to reverse-engineer, scrape, or abuse the API beyond your authorized usage
Circumvent rate limits, credit metering, or security controls
Resell access to the Service without an enterprise agreement

Violation of these rules may result in immediate account termination without refund.

8. API Usage

API access is available on all plans. Usage is metered via credits.
You must keep your API credentials confidential. Compromised keys should be reported immediately.
We may rate-limit or throttle API requests to protect service stability.
Bulk or automated usage beyond normal levels requires an enterprise agreement.

9. Availability and SLA

We aim for high availability but do not guarantee uninterrupted service.
We may perform maintenance with reasonable advance notice when possible.
Enterprise customers may negotiate separate SLA terms.
Third-party AI providers (ElevenLabs, OpenRouter, Fal.ai, HeyGen) have their own uptime characteristics that are outside our control.

10. Account Deletion

You may delete your account at any time from your account settings or by emailing privacy@monkeygun.com. Upon deletion:

Your account record is permanently erased
All videos and conversation history associated with your account are deleted
Any remaining credits are forfeited
Active subscriptions are cancelled
This action is irreversible

11. Limitation of Liability

To the maximum extent permitted by law, Monkeygun and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Monkeygun, its operators, and affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

13. Intellectual Property

The Monkeygun name, logo, and platform design are our intellectual property.
The underlying technology, APIs, and documentation are proprietary.
Open-source components used in the Service retain their respective licenses.

14. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the site at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Los Angeles County, California.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
